1. TERMS AND CONDITIONS ONE-DAY EXPERIENCES (ONE-DAY TOUR)

1. Objeto

1. Purpose

Los presentes Términos y Condiciones regulan la contratación de servicios turísticos de un día ofrecidos por DIASPORA TRAVELER SRL con RNC133364573 y domicilio en Calle Arzobispo Portes 156, Ciudad Colonial, Santo Domingo, República Dominicana y en lo adelante «LA EMPRESA».

These Terms and Conditions govern the contracting of one-day tourism services offered by DIASPORA TRAVELER SRL, Tax ID (RNC) 133364573, with registered address at Calle Arzobispo Portes 156, Ciudad Colonial, Santo Domingo, Dominican Republic, hereinafter referred to as «THE COMPANY.»

Nuestros tours pueden incluir, según el tour contratado: Transporte terrestre/Acuático, Coordinación logística, Guía turístico, Alimentación, Actividades recreativas y/o de riesgo (tales como, pero no limitadas a, senderismo, buceo, snorkel, tubing, cabalgatas y deportes de aventura). 

Our tours may include, depending on the selected tour: Ground transportation/Aquatic, Logistical coordination, Tour guide, Meals, Recreational and/or risk activities (such as, but not limited to, hiking, diving, snorkeling, tubing, horseback riding, and adventure sports).

Los servicios específicos estarán detallados en la descripción oficial de cada tour.

The specific services will be detailed in the official description of each tour.

2. Reservas y Pagos

2. Reservations and Payments

La reserva será confirmada una vez recibido el pago total.

The reservation will be confirmed once full payment has been received.

Los pagos pueden realizarse mediante transferencia bancaria, tarjeta de crédito/débito u otros métodos habilitados según el tour a contratar.

Payments may be made via bank transfer, credit/debit card, or other methods enabled for the selected tour.

El cliente acepta que cualquier comisión bancaria o cargo financiero asociado al método de pago no es responsabilidad de LA EMPRESA.

The client accepts that any bank commission or financial charge associated with the payment method is not the responsibility of THE COMPANY.

3. Política de Cancelación y Reembolsos

3. Cancellation and Refund Policy

Si la cancelación ocurre con menos de 48 horas de antelación a la hora de salida programada, se penalizará con el 100% del monto pagado, salvo que las condiciones particulares del tour contratado especifique una política de cancelación diferente.

If the cancellation occurs less than 48 hours prior to the scheduled departure time, a 100% penalty of the amount paid will apply, unless the specific conditions of the contracted tour specify a different cancellation policy.

En caso de reembolso por cancelación, el cliente será responsable de asumir las comisiones bancarias y gastos administrativos. Se entiende por «gastos administrativos» el costo incurrido en el procesamiento del reembolso, que será un monto fijo de entre USD 5.00 y USD 25.00.  

In the event of a refund due cancellation, the client shall be responsible for bank commissions and administrative expenses. «Administrative expenses» are understood as the cost incurred in processing the refund, which will be a fixed amount of between USD 5.00 and USD 25.00. 

SI LA EMPRESA cancela el tour por causas de fuerza mayor, condiciones climáticas adversas o razones de seguridad, el cliente podrá optar por:

If THE COMPANY cancels the tour due to force majeure, adverse weather conditions, or safety reasons, the client may choose:

1. Reprogramación sin penalidad. En caso de que el nuevo tour tenga un costo mayor, el cliente deberá cubrir la diferencia. En caso de ser menor, se le reembolsará la diferencia.

1. Rescheduling without penalty. In the event that the new tour has a higher cost, the client must cover the difference. If the cost is lower, the difference will be refunded.

2. Reembolso del monto pagado.

4. Actividades de Riesgo

4. Risk Activities

Algunos tours pueden incluir actividades consideradas de riesgo (senderismo, actividades acuáticas, deportes de aventura, entre otras).

Some tours may include activities considered risky (hiking, water activities, adventure sports, among others).

El cliente declara: Conocer y aceptar los riesgos inherentes a dichas actividades. Comprometerse a cumplir estrictamente las instrucciones de los guías y coordinadores.

The client declares: To know and accept the inherent risks of such activities. To strictly comply with the instructions of guides and coordinators.

En caso de contratación de actividad de riesgo, LA EMPRESA recomienda la contratación de un seguro que cubra los posibles riesgos.

In the case of booking a risk activity, THE COMPANY recommends purchasing insurance to cover potential risks.

El participante deberá firmar un descargo de responsabilidad antes de realizar actividades de riesgo. La negativa a firmar dicho descargo resultará en la exclusión inmediata de la actividad sin derecho a reembolso.

The participant shall sign a liability waiver before engaging in risk activities. Refusal to sign the waiver will result in immediate exclusion from the activity without the right to a refund.

5. Obligaciones del Participante

5. Participant Obligations

El cliente se compromete a: Presentarse puntual en el lugar y hora acordados. La no presentación por impuntualidad se considerará cancelación sin derecho a reembolso.

The client agrees to: Arrive on time at the agreed place and time. Failure to appear due to lateness will be considered a cancellation without refund.

Seguir las normas e instrucciones del guía y coordinadores. Utilizar adecuadamente los equipos de seguridad suministrados. Llevar el equipamiento personal necesario (ropa adecuada, calzado apropiado, medicamentos personales, etc.).

Follow the rules and instructions of the guide and coordinators. Properly use the provided safety equipment. Bring the necessary personal equipment (appropriate clothing, suitable footwear, personal medication, etc.).

Informar previamente cualquier restricción alimentaria, alergia o condición médica relevante. Abstenerse de realizar conductas que pongan en riesgo su integridad o la de los demás participantes.

Inform in advance of any dietary restriction, allergy, or relevant medical condition. Refrain from engaging in conduct that may endanger their own integrity or that of other participants.

LA EMPRESA se reserva el derecho de retirar del tour, sin derecho a reembolso, a cualquier participante que incurra en conducta imprudente, agresiva o que comprometa la seguridad del grupo.

THE COMPANY reserves the right to remove from the tour, without refund, any participant who engages in reckless, aggressive behavior or compromises the safety of the group.

6. Política para Menores de Edad

6. Minors Policy

Es responsabilidad del participante o tutor informarse previamente si la actividad contratada es apta para menores de edad.

It is the responsibility of the participant or guardian to verify in advance whether the contracted activity is suitable for minors.

Los menores de 18 años deberán estar acompañados obligatoriamente por uno de sus padres o por su representante legal debidamente autorizado.

Minors under 18 must be accompanied by one of their parents or a duly authorized legal representative.

El adulto acompañante será responsable del comportamiento, seguridad y cumplimiento de las normas por parte del menor.

The accompanying adult shall be responsible for the minor’s behavior, safety, and compliance with the rules.

LA EMPRESA podrá establecer restricciones de edad para determinadas actividades de riesgo, conforme a criterios de seguridad.

THE COMPANY may establish age restrictions for certain risk activities according to safety criteria.

7. Condiciones de Salud

7. Health Conditions

El participante declara encontrarse en condiciones físicas y de salud aptas para realizar las actividades contratadas.

The participant declares being in suitable physical and health condition to carry out the contracted activities.

En caso de padecer alguna condición médica relevante, deberá informarlo previamente. LA EMPRESA podrá limitar la participación en actividades específicas si considera que existe riesgo para el participante o el grupo.

If suffering from any relevant medical condition, it must be disclosed in advance. THE COMPANY may limit participation in specific activities if it considers there is a risk to the participant or the group.

8. Limitación de Responsabilidad

8. Limitation of Liability

LA EMPRESA no será responsable por: Pérdida o daño de objetos personales. Accidentes derivados del incumplimiento de instrucciones. Actos imprudentes o negligentes del participante. Situaciones de fuerza mayor (clima extremo, disposiciones gubernamentales, accidentes externos, etc.).

THE COMPANY shall not be responsible for: Loss or damage to personal belongings. Accidents resulting from failure to follow instructions. Reckless or negligent acts of the participant. Force majeure situations (extreme weather, governmental provisions, external accidents, etc.).

No obstante, LA EMPRESA garantiza que los servicios serán prestados bajo estándares razonables de calidad y seguridad conforme a la legislación vigente. En ningún caso, la responsabilidad de LA EMPRESA por daños directos excederá el monto total pagado por el cliente por el tour contratado, salvo en casos de dolo o negligencia grave debidamente comprobados.

Nevertheless, THE COMPANY guarantees that services will be provided under reasonable standards of quality and safety in accordance with applicable law. In no event shall THE COMPANY’s liability for direct damages exceed the total amount paid by the client for the contracted tour, except in cases of proven willful misconduct or gross negligence.

9. Modificaciones del Itinerario

9. Itinerary Modifications

Por razones operativas, climáticas o de seguridad, LA EMPRESA podrá modificar el orden del itinerario o sustituir actividades por otras similares sin que ello genere responsabilidad adicional.

For operational, weather, or safety reasons, THE COMPANY may modify the order of the itinerary or substitute activities with similar ones without generating additional liability.

10. Legislación Aplicable y Jurisdicción

10. Governing Law and Jurisdiction

Estos Términos y Condiciones se rigen por las leyes de la República Dominicana. Cualquier controversia será conocida por los tribunales competentes conforme a la Ley Dominicana.

These Terms and Conditions are governed by the laws of the Dominican Republic. Any dispute shall be submitted to the competent courts in accordance with Dominican Law.

11. Política de privacidad

11. Policy Privacy

LA EMPRESA es la Responsable del Tratamiento de sus datos para gestionar los servicios contratados. Sus datos podrán ser compartidos con proveedores esenciales del tour y según obligación legal. Se conservarán por el tiempo del contrato y los plazos legales aplicables. Consulte la política completa en: Política de Privacidad

THE COMPANY is the Data Controller for your data, processed under your express consent (T&C acceptance) to manage contracted services.Your data may be shared with essential tour providers and as required by legal obligation. Data will be retained for the contract term and applicable legal periods. Consult the full policy at: Policy Privacy

12. Cláusula de Interpretación

12. Interpretation Clause

En caso de conflicto, contradicción o diferencia de interpretación entre la versión en español y la versión en inglés del presente contrato, prevalecerá y será legalmente vinculante la versión redactada en idioma español.

In the event of any conflict, contradiction, or difference in interpretation between the Spanish and English versions of this contract, THE SPANISH-LANGUAGE VERSION SHALL PREVAIL AND BE LEGALLY BINDING.
